1. Introduction & Terminology

Welcome to Physics with Keith. By enrolling in our courses, you (the “Parent/Guardian”) agree to these terms on behalf of yourself and the Student.

  • “We/Us/Keith”: Refers to Physics with Keith.
  • “Course”: Any tuition session, membership, or digital resource provided.
  • “The Parent/You”: The person responsible for payment and student supervision.
  • “Student”: The child attending the course.

2. Enrolment and Payment

2.1 Contract: A contract is formed once you complete the subscription. Payments are processed securely via Stripe or PayPal

2.2 Access: Access is granted to the email address provided during registration. Subscriptions are for the named student only and are non-transferable.

2.3 Non-Payment: We reserve the right to suspend or terminate access immediately if subscription payments fail or are cancelled.

3. Cancellation and Refund Policy

3.1 Cooling-Off Period: Under UK Consumer Law, you have 14 days from the date of purchase to cancel your subscription for a full refund.

3.2 Waiver for Instant Access: If you access the digital Course materials or attend a live session within this 14-day period, you acknowledge that you are requesting the service to begin immediately and may lose the right to a full refund.

3.3 Monthly Subscriptions: You may cancel your subscription at any time via your account dashboard. Cancellation stops future payments; however, no pro-rata refunds are given for the remaining days of the current billing cycle.

3.4 Transaction Fees: Please note that Stripe (our payment processor) does not refund their transaction fees to us when a refund is issued. Therefore, any refund provided—whether during a cooling-off period or at our sole discretion—will be the total amount paid minus the Stripe processing fee.

4. Code of Conduct

To ensure a productive learning environment, Students must:

  • Refrain from hateful communication (racism, sexism, homophobia, etc.).
  • Not share personal contact details (social media, addresses) with other students.
  • Not “spam” or disrupt the YouTube Live chat or Whiteboard.fi sessions. Sanctions: Persistent or serious misbehaviour will result in expulsion from the Course without a refund.

5. Liability & Disclaimer

5.1 Educational Outcome: While we strive for excellence, we do not guarantee specific exam results or grades.

5.2 Downloads: We are not liable for any technical issues or damage to your device resulting from downloading educational files, though we ensure all files are scanned for viruses.

5.3 Dates, days and times: Occasionally, We have to postpone the regular tuition sessions. We will endeavour to give as much notice as possible using the Programme of tuition sessions at the bottom of each Dashboard page. We also regularly monitor attendance and participation patterns and may occasionally change the tuition days or times on a more permanent basis. You will be given notice of this, and you have the right to cancel your enrolment at any time.

6. Data Protection & Publicity

6.1 Privacy: We process data in accordance with our Privacy Policy.

6.2 Publicity: We may use redacted examples of student work (names removed) for educational or promotional purposes. We will not use student images or recordings without a separate, explicit consent form from the Parent.

7. Safeguarding

7.1 Professional Standards: Keith is a qualified teacher with an enhanced DBS (on the Update Service).

7.2 Environment: All tuition sessions are “one-way” video/audio (Teacher to Student). No student video or audio is collected.

7.3 Communication: All administrative or scheduling communication must be between Keith and the Parent. No private contact with Students via social media is permitted.

7.4 Reporting: We have a legal duty to report any safeguarding concerns to the relevant authorities or the student’s school.

7.5 GCSE Astronomy Observation Verification: Unlike our standard group sessions, the Astronomy Observation Verification service requires a 1:1 Zoom meeting to verify the authenticity of the Student’s work.

7.5.1 Parental Attendance: Parents/Guardians are strongly encouraged to attend or be present in the room during these 1:1 sessions.

7.5.2 Video/Audio: These sessions require both the tutor and Student to use video and audio.

7.5.3 Recording: For the protection of both the Student and the Tutor, all 1:1 Zoom sessions are recorded for safeguarding purposes only. These recordings are stored securely and deleted once the verification process is complete and the 14-day appeal window has passed.

8. Force Majeure

We are not liable for failure to perform our obligations due to events beyond our reasonable control (e.g., widespread internet outages, illness, or national emergencies). In such cases, we will endeavour to provide recorded sessions or alternative dates.

9. Governing Law

These terms are governed by the laws of England and Wales.
